Kaimeleon.ai – Terms of Service

1. Eligibility

To use Kaimeleon, you must:

• Be at least 16 years of age, or the legal age of digital consent in your country.
• Have the authority to enter into binding contracts.
• Not be a person barred from using such services under applicable laws.

2. Description of Services

Kaimeleon provides business automation tools including, but not limited to:

• Email triage powered by AI
• Client and operational insights
• Workflow automation integrations
• Natural language processing and knowledge extraction

We reserve the right to modify, enhance, or discontinue any feature or service at our sole discretion, with or without prior notice.

3. User Obligations

By accessing the Platform, you agree to:

• Provide accurate and complete information during registration.
• Maintain the confidentiality of your login credentials.
• Be solely responsible for all activity under your account.
• Use the Services in compliance with all applicable laws and regulations.

You agree not to:

• Use the Platform for unlawful, harmful, or fraudulent purposes.
• Attempt to reverse-engineer, scrape, or copy Kaimeleon's systems or content.
• Upload or transmit malicious code, viruses, or harmful scripts.
• Infringe upon intellectual property rights or proprietary content.
• Misrepresent your identity or affiliation.

4. Payment and Billing

Certain Services require payment. You agree to:

• Pay all fees according to the pricing plan you selected.
• Authorize us to charge your payment method on a recurring basis (if applicable).
• Ensure your billing details are up to date.

Subscription terms:

• Subscriptions automatically renew unless cancelled before the renewal date.
• You may cancel anytime; access will continue until the end of the billing period.
• Refunds are available within 14 days of initial purchase, unless Services have been fully used.

5. Intellectual Property

All content, tools, algorithms, text, graphics, branding, and software on the Platform are the exclusive property of Kaimeleon or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services strictly for your internal business use.

You may not:

• Reproduce, distribute, or commercially exploit any part of the Platform.
• Use Kaimeleon branding or trademarks without express written consent.

6. Data & Privacy

Kaimeleon processes personal data in accordance with applicable data protection laws (incl. GDPR). See our Privacy Policy for full details.

We do not sell personal data. You remain the data controller for any content or personal data you upload to the Platform.

7. Service Availability and Support

We aim to ensure high availability but do not guarantee uninterrupted access. We may perform maintenance or updates without notice. Technical support is provided on a best-effort basis via help@kaimeleon.ai.

8. Limitation of Liability

To the fullest extent permitted by law:

• Kaimeleon is not liable for any indirect, incidental, punitive, or consequential damages, including lost profits, lost data, business interruption, or reputational harm.
• Our total liability for any claims arising under these Terms will not exceed the total amount you paid us in the 6 months preceding the claim, or €100, whichever is greater.

You acknowledge that the Services are provided “as is” and “as available”, without warranties of any kind.

9. Termination

We may suspend or terminate your access:

• If you violate these Terms or applicable law;
• If you engage in abusive or fraudulent activity;
• Upon reasonable suspicion of security risk.

You may also terminate your account at any time by contacting help@kaimeleon.ai.

Upon termination:

• Your license to access the Services ends immediately.
• Your data may be deleted in accordance with our retention policy.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Belgium. Any disputes shall be submitted to the exclusive jurisdiction of the competent courts in Ghent, Belgium.

11. Modifications to Terms

We may update these Terms periodically. If changes are material, we will notify you via email or in-app notification. Continued use of the Services after such notice constitutes acceptance of the updated Terms.
